Terms of Service

By using PixTrace, you agree to these Terms. Governing law: French law.

1. Purpose

These Terms of Service ("Terms") govern access to and use of the PixTrace service, available at https://pixtrace.io and via the PixTrace mobile application (iOS and Android), operated by PixTrace ("PixTrace", "we", "us"). By creating an account or using the service, you agree to these Terms in full. If you do not agree, do not use the service.

2. Description of the Service

PixTrace is an AI-powered image analysis service that extracts geographic information, EXIF metadata, and contextual data from digital photographs. The service is accessible via a web browser, a REST API, and a mobile application. PixTrace is intended for lawful use only, including but not limited to journalistic investigation, open-source intelligence (OSINT), and image verification.

3. Account Registration

Access to the service requires creating an account. You agree to provide accurate information during registration and to maintain the confidentiality of your credentials. You are responsible for all actions performed under your account. If you suspect unauthorized use, contact us immediately at contact@pixtrace.io. You must be at least 16 years old to use PixTrace.

4. Subscriptions and Payments

PixTrace offers subscription plans providing a defined number of analyses per month. Unused credits do not carry over to the following billing cycle. Web subscriptions: Payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method each month on the anniversary of your subscription. Mobile app subscriptions (iOS / Android): Payments are processed by Apple (App Store) or Google (Google Play). By subscribing through the mobile app: • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. • Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. • You can manage or cancel your subscription in your device settings (iOS: Settings → Apple ID → Subscriptions; Android: Google Play → Subscriptions). • No cancellation of the current period is allowed once activated. All prices are displayed in USD. Applicable taxes may apply depending on your jurisdiction. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — your remaining credits stay accessible until that date.

5. Free Trial and Free Credits

PixTrace may offer a limited number of free analyses upon account creation. These credits are non-transferable and may be subject to change. Free credits are provided for evaluation purposes and do not create an obligation to continue the service.

6. Refund Policy

Digital services: Once an analysis has been performed, it cannot be reversed. Refunds are not available for consumed credits. A pro-rata refund may be granted exceptionally if a technical failure attributable to PixTrace prevented use of the service. Contact contact@pixtrace.io within 7 days of the issue. Unused credits are not refundable upon voluntary cancellation. For subscriptions purchased through the App Store or Google Play, refund requests must be directed to Apple or Google respectively, in accordance with their refund policies.

7. Acceptable Use

You agree not to use PixTrace to: • Analyze images of individuals without their consent for the purpose of illegal surveillance • Violate the image rights or privacy of third parties • Identify individuals for the purpose of harassment, discrimination, or persecution • Circumvent the security measures of the service • Resell access to the service to third parties without written authorization • Use the service in violation of any applicable local, national, or international law PixTrace reserves the right to suspend any account in violation of these rules, without refund.

8. Intellectual Property

The PixTrace service, its interface, code, and brand are the exclusive property of PixTrace. No license is granted on these elements. You retain ownership of the images you submit. By using the service, you grant PixTrace a limited and temporary license to process these images solely for the purpose of executing the requested analysis.

9. Personal Data and GDPR

PixTrace processes your personal data in accordance with the General Data Protection Regulation (GDPR — EU 2016/679) and applicable data protection laws. You have the following rights over your data: access, rectification, erasure, portability, restriction, and objection. These rights can be exercised from Dashboard → Settings or by email at contact@pixtrace.io. Your data is hosted in the European Union. We do not sell your data to third parties. You also have the right to lodge a complaint with a supervisory authority. For users in France, this is the CNIL (Commission Nationale de l'Informatique et des Libertés — www.cnil.fr). 10. Automated Processing

PixTrace uses artificial intelligence and automated systems to analyze images. The results are provided for informational purposes and do not constitute definitive proof. You have the right to contest the results of automated processing by contacting contact@pixtrace.io.

11. Limitation of Liability

PixTrace provides the service "as is" and does not guarantee the accuracy of analysis results. The information provided is for informational purposes only and does not constitute legal evidence. PixTrace shall not be liable for any decision made based on analysis results, any service interruption, or any indirect damages resulting from use of the service. PixTrace's liability is limited to the amount paid by you during the 3 months preceding the event giving rise to the claim.

12. Modifications to These Terms

PixTrace reserves the right to modify these Terms at any time. Users will be notified by email or via a notification in the service at least 15 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing agreement, the courts of France shall have exclusive jurisdiction. In accordance with European consumer protection regulations, you may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
